Terms of Use

These Terms of Use govern access to and use of the Stacks service operated by Jose Araneta. They describe the Stacks service, explain the commitments users make when using it, and protect Stacks from legal and operational risks associated with user-generated content, collaboration, media sharing, optional location-based access features, subscriptions, and optional AI-assisted features.

Important Notice

These Terms govern your use of Stacks and should be read together with the Privacy Policy, Data Deletion and Retention page, Community Guidelines, AI Feature Disclosure, and Copyright and DMCA Policy.

1. The Stacks Service

Stacks is a mobile-first service operated by Jose Araneta that allows users to create, organize, store, share, collaborate on, and view stacks containing photos, videos, GIF-based content, text, narration notes, audio, and related media. The service may include account creation and profile management, stack and card creation tools, media upload and playback, collaboration and viewer access controls, optional location-based access features, notifications, optional AI-assisted tools, storage subscriptions, consumable AI-credit purchases, and related support and legal pages.

2. Who Can Use Stacks

To use Stacks, users must be at least 13 years old, or older where a higher minimum age is required by applicable law, be legally capable of entering into a binding agreement, not be prohibited from using the service under applicable law, and not use the service if their account has previously been disabled or terminated for serious violations unless Stacks expressly authorizes their return.

3. Your Account And Registration Information

You are responsible for your account and agree to provide accurate, current, and complete registration information, keep your password and credentials secure, promptly update inaccurate information, notify Stacks if your account is no longer secure, and accept responsibility for activity under your account except to the extent caused by Stacks' own failure to safeguard account access.

4. Your Commitments To Stacks

In exchange for our agreement to provide the service, you agree to use Stacks lawfully and responsibly, not violate the rights of others, not misuse the service or its access controls, and not use Stacks to stalk, harass, threaten, exploit, surveil, spam, or otherwise harm other people.

5. Your Content

User Content means the content you upload, submit, record, create, store, transmit, generate, or otherwise make available through Stacks, including photos, videos, GIF-based content, captions, narration notes, comments, text, audio, prompts, generated outputs you choose to keep, profile content, and related metadata. You retain ownership of your User Content, but you grant us the permissions we need to operate the service.

6. Permissions You Give To Us

When you upload, share, post, or otherwise make available User Content on or in connection with Stacks, you grant Stacks a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to host, store, use, reproduce, modify for technical formatting, adapt, process, transmit, display, distribute, and perform that content as necessary to provide and operate the service, enable your sharing and collaboration settings, secure and improve the service, process AI-assisted features you choose to use, back up and restore systems, and comply with legal obligations and policy enforcement needs.

7. You Are Responsible For The Content You Upload

You represent and warrant that you own your User Content or have all rights and permissions necessary to upload, share, generate, and use it, that your User Content and your use of it on Stacks do not violate law or the rights of others, that you have all required permissions to record, upload, process, and share voices, images, likenesses, and personal information of other people, and that your User Content complies with these Terms and all applicable Stacks policies.

9. Sharing, Collaboration, And Access-Controlled Features

Stacks allows users to share content and, in some cases, collaborate on it. Owners, collaborators, viewers, and other permitted users may have different rights and capabilities; content visibility may depend on the sharing and access settings chosen by the user; some content may be subject to geo-lock, timing, storage-tier, or other access-related restrictions; and no access-control system is perfect, so Stacks cannot guarantee that every restriction, unlock, or permission state will always function without error or interruption.

10. Optional AI-Assisted Features

Stacks may offer optional AI-assisted features, including in-app media-generation or editing tools powered in whole or in part by third-party AI providers. If you choose to use any AI-assisted feature, prompts, source media, generated outputs, and related request metadata may be transmitted to a third party for processing, the output may be inaccurate or unsuitable, and you remain responsible for reviewing and editing the output before using or sharing it.

11. Fees, Payments, And Purchases

Certain features of Stacks may require payment, including recurring storage subscriptions and one-time purchases of consumable AI credits. Prices, included features, usage rates, and eligibility rules may change prospectively. Unless otherwise expressly stated, purchases are processed by Apple through your Apple account, and Apple may apply its own terms, billing procedures, refund processes, taxes, and payment-method rules in addition to these Terms.

12. Storage Subscriptions

Paid storage plans provide increased storage capacity and related feature access for the subscription period shown at purchase. Storage subscriptions are intended to renew automatically through Apple at the end of each billing period until canceled. You are responsible for managing, canceling, or changing your subscription through Apple using the tools Apple makes available. Cancellation generally stops future renewals but does not retroactively refund past charges except where Apple or applicable law requires otherwise.

If a subscription lapses, expires, is canceled, is suspended, fails to renew, or is reversed, Stacks may reduce your available storage tier, limit uploads, limit editing, disable certain AI-related purchases or features, place accounts or collaborators into read-only or otherwise restricted states, and continue enforcing usage limits until the account returns to an eligible status.

13. AI Credits And Consumable Purchases

Stacks may offer consumable AI credits that can be used for eligible AI-assisted media-generation or editing features. Credits are licensed, not sold, have no cash value, are non-transferable, are non-sublicensable, and may be redeemed only within the Stacks service for the eligible feature types and usage rates then in effect. Except where required by law or where a refund is granted by Apple or another applicable platform provider, purchases are final once credits are applied to your account.

Stacks may deny, delay, reverse, withhold, or adjust credits where a purchase is revoked, reversed, charged back, refunded, duplicated, associated with fraud or abuse, issued due to technical error, or otherwise not validly completed. If Apple or another billing provider reverses a payment, Stacks may remove the related credits, reduce your balance, create a negative or adjustment balance, or suspend related feature access until the issue is resolved.

14. Third-Party Services

Stacks may rely on third-party providers for infrastructure, authentication, hosting, storage, notifications, media discovery, AI processing, payments, and other service functions. Stacks may also provide outbound links to third-party tools or services. To the fullest extent permitted by law, Stacks is not responsible for the products, services, availability, content, billing decisions, or policies of those third-party providers except as required by law.

15. Content Removal And Restricting Or Ending Access

Stacks may remove or restrict content, limit features, suspend accounts, terminate access, block uploads, disable sharing or collaboration tools, reverse feature entitlements, or preserve information for review where it reasonably believes doing so is necessary to enforce Terms and policies, protect users, address abuse or security risks, respond to payment problems, comply with law, or reduce legal or operational harm.

16. Additional Rights We Retain

Stacks reserves all rights not expressly granted to users, including the right to change a username or identifier where appropriate, retain rights in Stacks-owned content and branding, and restrict use of those materials except as expressly permitted.

17. Intellectual Property

Except for User Content, the service and all related software, text, designs, graphics, interfaces, trademarks, logos, and other materials made available by Stacks are owned by Stacks or its licensors and are protected by applicable law. Except as expressly permitted, users may not copy, modify, distribute, sell, lease, create derivative works from, decompile, or otherwise exploit any part of the service.

18. Prohibited Uses

You may not use Stacks to spam, mass-message, manipulate engagement, run unauthorized commercial promotions, distribute malware, probe or test system vulnerabilities without authorization, scrape or harvest data, evade enforcement, create accounts by automated means, impersonate another person, generate deceptive or harmful AI content, create or distribute non-consensual intimate media, facilitate harassment or stalking, infringe intellectual property rights, or use the service in a way that creates unreasonable load, legal exposure, or safety risk for Stacks or others.

19. Service Availability, Security, And Data Integrity

You understand that the service may be unavailable, interrupted, delayed, or degraded; uploads, notifications, media playback, collaboration features, geo-lock checks, billing integrations, quota checks, and other functionality may fail or behave unexpectedly; content may be lost, corrupted, delayed, or become unavailable; and no security measures can guarantee complete protection against unauthorized access or misuse.

20. Deletion, Backups, And Retention

If you delete content or request deletion of your account, Stacks begins processing the request through an asynchronous deletion workflow. Some data may be removed from active systems promptly, but deletion may not be immediate across all systems. Content may remain in backup or disaster-recovery systems for a limited period, some information may be retained where reasonably necessary for legal compliance, fraud prevention, abuse investigations, security, dispute resolution, payment reconciliation, or technical integrity, and permissions and rights reasonably necessary for those limited purposes may continue until the relevant deletion process is complete.

21. Disclaimers

To the fullest extent permitted by law, Stacks is provided "as is" and "as available" without warranties of any kind. Stacks does not warrant that the service will always be available, secure, or error-free, that content will never be lost or corrupted, that third-party services will remain available, that access controls or geo-locks will always function perfectly, that storage limits or billing integrations will always update without delay or error, or that AI-assisted output will be accurate, reliable, lawful, non-infringing, or fit for any purpose.

22. Limitation Of Liability

To the fullest extent permitted by law, Stacks and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenues, data, goodwill, content, business opportunities, or digital assets arising out of or relating to the service or these Terms. To the fullest extent permitted by law, Stacks' total aggregate liability for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid to Stacks, if any, in the 12 months before the event giving rise to the claim or USD $100.

23. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Stacks and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, prompts, AI outputs you use or share, misuse of the service, violation of these Terms or applicable law, violation of the rights of another person or entity, payment disputes caused by your conduct, or disputes involving shared, collaborative, uploaded, generated, or recorded content.

24. Updating These Terms

Stacks may change the service and policies and may need to make changes to these Terms so they accurately reflect the service and legal, operational, safety, and billing requirements. Unless otherwise required by law, users may be notified before updated Terms take effect, and continued use after they become effective may constitute acceptance.

25. Governing Law And Disputes

To the fullest extent permitted by applicable law, these Terms and disputes arising out of or relating to Stacks will be governed by applicable law and resolved in a court of competent jurisdiction unless a different process is required by law.
